UPS lost a Box and Seller Won't Give Money Back!

I bought 20 boxes of clothes from a guy (nuwear) and UPS lost one of the boxes. This took place back in September of this year and he has not submitted any claim paperwork with UPS. I want my 500 bucks back and UPS said it is up to the shippers responsibility to complete the paperwork. I already filed a complaint with Better Business Breau and doesn't seem like he cares. Is there anything I can do?

Sounds like this guy didn't buy insurance when he shipped. You could always try the AG for his state. Or small claims court in your state and if he doesn't show up or get counsel, you may get a judgement.

how did you pay him? If you paid through paypal or a credit card, you can contact them and you MIGHT get your money back.

He did buy insurance as UPS told me they are just waiting on his paperwork for a refund. My guess if he did fill it out that he wouldn't even give me the money for it. I paid via bank wire. Any way I can call UPS and they can try to help me? They are the ones who lost a huge box.

I would call UPS and tell them that the sender is not helping you, UPS knows how many boxes the guy sent you if it is more than one. You can look up your tracking number from the UPS site and it will say on the invoice how many boxes he sent, and the UPS man who delivered the boxes SHOULD have scanned every box when delivered so USP should know that your missing a box, I would call them right away and tell them of the problem, maybe they can help you. I know a lot of people dont like paypal, but I have used paypal for about 5-6 years now if I am remembering correctly and I have only had 2 charge backs, in both cases I got my money back since I could provide a tracking number. The only problem I see is that UPS will not know what was in the box, so if you have an inventory price sheet of what was suppose to be sent to you, you would need it, I am sure the sender of the packages will also need it so they know what you did not receive. I would also call my bank and ask them if they have any suggestions on what you could do since they sent the money they might have an idea, and then there is also small claims court, if you go file for $35.00 the sender might just get off his butt! It would be worth the $35.00 if you had a lot of money wrapped up in the missing box. And for your proof you would only need the UPS tracking numbers and your emails back and forth to him about the missing package. Hope you can reslove this quickly. Marilyn

UPS has a contract with nuwear, not you. He paid for the shipping so he gets the money.
I did a search here for nuwear and he did 3 posts about his site. When you click his links, they are dead. But the website is men's underwear now.

His registration does match his website. Try posting the information on the Have you Dealt With section. He may show up and decide to do the right thing.

Pay with credit card in this country, so you have some protection. No more bank transfers unless you have met the person. Bank will tell you once it leaves the bank they can do nothing.
