My friend bought a mac mini on ebay. The selle said he was selling it as is and that it was untested because he had to many to test.
When my friend got his package he got his mac mini but realised it was just the mac mini box ( no parts inside)
He paid with paypal and lives in the USA and the seller lives ini the USA.
Can he get his money back and hold the seller liable? The auction did say "as is"

Most likely he can get his money back depending on how bad he wants it. Hopefully your friend paid through paypal via his credit card, in which case have him call his credit card company. If he did not pay through his credit card, he can still file a claim against the seller through paypal, which can sometimes result in a refund (though not your best bet).
A good idea is to call the seller immediately and ask them what is up, and depending on their response, your next call could & should be to the local police. The more pressure you can put on the seller, the better, especially with the holiday season getting in gear since that is when he's going to depend on selling the most.
