VERO cancelled abercrombie auctions

I just had a number of my Abercrombie items on ebay cancelled by VERO. I was using Abercrombie stock photos (my mistake) on the ones that got cancelled. The ones I used my own photos for were not cancelled. The email ebay sent me says :"If you relist this or any other similar items on eBay, your account likely will be suspended."
Has this happened to anyone? Will I get suspended if I use my own photos to relist the items they cancelled? -
I've never heard about any activity of VERO Abercrombie before. Are you sure it's because of the pictures? What reason for your listings' termination does eBay provide in the email you've got? Is there a phrase "your listing uses a rights owner's image and/or copyrighted text without authorization" ?
If so that's a bad news. I have nothing against my own photos, but Abercrombie buyers on eBay are probably the most used to stock pictures. I've noticed on many occasions that Abercrombie listings receive substantially more bids when stock photos are used, and most of sellers use them. It will take time to adjust...
In response to your question in the other thread: I sent, like, three emails to the VERO RL member but did not manage to get a response. I got rid of copyrighted images and any text that might've resembled RL advertising. So far so good <keeps fingers crossed>

The email said the auctions were terminated:

I know I was shocked because I have never heard of Abercrombie closing down auctions before. Maybe this is the start of something new? I don't know, mayber I was just unlucky. There were 4 that they missed with stock photos, and I quickly replaced the photos with my own.
It is weird because if you just search "abercrombie" in any clothing category, 80-90% of the thousands of auctions that come up are using stock photos. Oh well, I can tell you I will not ever use them again!!! -

They usually don't care if people use their photos but sometimes they like to target certain people, they do it to me from time to time, it's like the company wants to bother someone so they try to find a way to do it. Their pictures aren't copywritten from what I believe but I would try to argue with Vero, the email you got should have the abercrombie reps info so you could email them personally. Let me tell you, they pinpointed me for selling 7FAM jeans on ebay I am assuming b/c I was moving them very fast and at prices half of what others sell them for because they didn't say that they were fake or anything, and from what I have found out they don't have to give a reason so this is my only thoughts. So now I can't sell them on their anymore. I do once in a while in very small quantities though. I have also been pinpointed by evisu, once because I listed an item that I thought was real when in fact it wasn't, fine so be it, my mistake, but then I got authentic items and everytime I listed them I was VeRo'd. What I did with the 7FAM jeans was I waited about 2 weeks after the email from them and relisted them with different pics and only a few pairs at a time rather than the 20 I was listing, they didn't bother me after that.

Well DUH. It is exactly the same email I got with regard to RL listings. Looks like A&F has finally started monitoring eBay. I don't think yours were the only listings pulled. It would take some time for them to make a difference as there indeed are hundreds of sellers, but I must say that I see much less RL auctions with stock photos now than there were a few months ago.
Well, at least there is no need to search frantically for a stock picture of every item anymore.
I think it's a good idea to email the VERO member regardless of whether there will be a reply. I was reluctant to do it at first, but after listiening to opinions of members of this Forum decided to go ahead. My name (and yours) is in the list anyway. So there is no harm that I admitted my wrongdoing and brought my apologies. I also noted that I had my listings revised and asked to take a look.
It's not like your items were pulled for being counterfeit.
It's just the pictures that you need to correct.

I agree, you guys should contact them, I think that they are being petty and they are trying to make it difficult for you b/c the less you sell the more they sell, at least that's how they see it. I had the issue with the 7 jeans, they weren't counterfeit and they didn't use that as their excuse, they actually gave me no reason, and they only pulled half of my listings, not all which I thought was odd. I didn't use stock photos, I used my own too. I ended up having to put them up little by little so be aware that if they do that to you, doing it that way will be the way to get them sold. Once they have you blacklisted they watch you like hawks.

Till now, A&F don`t care, but other times come. If you don`t have an A&F agreement for the pictures you are not allowed to use it, there is a regular copyright on pictures. -
Ok, I see, either way, that is very petty, they are trying to make it more difficult for people to sell on ebay. I have been going through problems with Vero myself, Evisu doesn't want me to sell their items, they are authentic but they are giving me a hard time and now b/c of it ebay is reviewing suspension, I emailed them all to figure out what is going on and what to do, it's ridiculous, either way, whether it sells in their store, a wholesaler, bootlegger, or ebay, it's going to sell and I don't understand why they keep harrassing people like this.

You can do anything against it, when they want to remove it, they remove it. But since you`re US based, sell authentic merchandise and use your own pictures and don`t use the A&F one or from other sellers. -
Same thing happened to me with selling AF jeans - it seems they are targeting some sellers but not all. I took a chance and relisted mine and haven't had another problem. I try not to use all stock photos though.

It's not just AF it's a few different ones, and from what I see they target certain people and then you kind of get blacklisted and your items are the first ones that all of the reps go to, I am going through it now, they cancelled 18 of my auctions again and I believe I may be suspended. This time for pics, this is ridiculous, they are telling me to NOT relist AT ALL!!!! So I can't sell the 18 items that I have, I am stuck, I can't stand it anymore.

It's very frustrating, especially when it feels like they are picking on you and leaving thousands of other auctions going. I see lots of abercrombie auctions using not only their photos, but logos and model pictures taken directly from their website! I am not even that big in abercrombie, so I am surprised they picked on me. It does make me think someone must have reported me to abercrombie or something. Now I don't know what to do with all the abercrombie stuff I have and am scared to list.

Me too, I only usually had 5-10 AF auctions going, and there are sellers with 50-100 items out there. Why me?

your not alone, I have had 3 companies go after me already! I had 7FAM jeans go after me, but I had 18 auctions up and they only cancelled 9 of them, the ones that had ended and people paid for already. They didn't give me a reason why, my items are real, I don't get it, then I had evisu which I found that one shirt was fake, I wasn't aware b/c it was the first time I tried to sell evisu so I understood, then evisu again with an authentic item, then just the other day True Religion! That was the last straw for me b/c the TR jeans that I have ARE real and I used pics from sites but not their site and I noticed that other sellers used the same pics and didn't get booted. It seems to me as though there is a blacklist or something b/c it's non stop. Now I got stuck with the TR jeans and have to find where to sell them. I had 12 but I sold 5 wholesale for not much more than I paid and then I am left with 7, I listed them on ioffer, I figured it was my only choice, hopefully they will sell. I did email vero b/c last time I dealt with them they threatened suspension. I told them that I tried to contact the manufacturers for all of the items to get more insight and got no response and I can't rectify the situation unless they get back to me, now I am pending suspension and it scares me b/c I can't afford that, this is my bread and butter! I gave Vero a piece of my mind telling them that I felt as though I was targeted and for this to keep happening to me means there must be a blacklist that my name is on the top of and I want to stop going through it. Haven't heard back yet though. I also told them that there are plenty of sellers who blatenly sell bootleg items and what not and they don't get hit, they keep selling and it isn't fair. Maybe you should email vero and see what they say, last time I talked to Chase in vero and he was very nice and understanding and as far as those items, you might as well forget about selling them on ebay b/c they will suspend you for it so stick them on here or on ioffer or something.

So your driving down the road and a speeder goes past you doing 100mph, 5 miles up the road you get busted for doing 85 in a 55. Are you going to tell the cop a guy just passed doing 100mph and expect him to let you go?
You are breaking the law, period, using A&F logos, photos, designs, etc...
Suck it up, stop pointing fingers at other sellers far outweighing your already illegal activity. -
They definately have me on some list now! I just got 2 ralph lauren items vero'd. I have been selling them for 6 months with no problems. A very small picture that I forgot I had in the auction was their photo. I have over 100 items up right now and these were the 2 they found and vero'd right away. I thought I had gone through all my auctions to be sure none of them had photos that I did not take. Again, they left alone the auctions that had my own pictures on them. But now I am being watched by abercrombie and ralph lauren. All I can say to anyone out there still using stock photos is to watch out, because if they catch you once, they must report you to other designers right away.

as far as my items being authentic, yes they are. Most of the abercrobmie items vero'd were ones I bought at the abercrombie outlet myself. Unfortunatlely I was too lazy to take a picture myself and just searched for a picture instead. Lesson learned... always use your own pictures!!

As a Power Seller who has been suspended for life on ebay for various reasons, I can tell you my personal experience with VeRO. Take it for what it's worth. I sold fake Juicy's on ebay. After awhile, I got VeRO'd by Liz Claiborne. Their legal dept called me personally on my home phone, in fact.
Anyway, ebay told me that the only way for me to sell Juicys again on ebay was to get a letter of authorization from Liz Claiborne and fax that to ebay. To make story short, I had access to authentic Juicy's and I wrote Liz Claiborne to send me a letter of authorization if I provided them with all the paper work they wanted/needed. I did not mention that I had VeRO problem with ebay. I told them that I had heard about VeRO program and that I did not want to invest any money unless I could be sure I can sell on ebay. Liz Claiborne said "NO". They just did not care or want to hear it. Authentic or not, paper work or not, they didn't care. In fact, ebay told me that even if I bought it from Neiman Marcus and had recipt to prove it, I STILL could not sell on ebay because I did not have that letter from LC. It seemed to me that it was not a matter of authenticity but a matter of competition (against their authorized dealers) and bad image. And ebay is not going to go to bat for you because they would rather !@#$ off a little seller than !@#$ off LC and have them sue ebay. Lot more thoughts...but that is just one of my personal experience with ebay VeRO. -
If your items were authentic and you weren't allowed to sell them on ebay, you can always sue the trademark holder. Tabberone has sued about a dozen different trademark holders that tried to VERO her auctions. I believe she has won 10 of them and has 2 still pending.
If the items are authentic the trademark holder can't stop you from selling. They don't have to give you a letter of authorization, but they can't VERO you either. If they do VERO you for selling authentic goods, they are committing a tort of business interference. -
I get that. And I know who Tabberone is. But the point is...who is going to take all those steps? I certainly dont have the time or the will to pursue that avenue. Most on ebay dont either.

Jabbu, your metaphor was ver interesting, so interesting that it was much like the one that Jack from Vero used when writing me, he told me that if everyone was speeding and I got pulled over, I just happened to be the unlucky one and that's it. Not in those words, but anyhow, I would not rat out another seller, it's kind of like the thing you DON'T do to other sellers on ebay and I know this I mind mine and you mind yours, but my point was not that I would rat on them, it was that they are pinpointing me for nothing b/c I had authentic items that I could no longer list where others have pics up of items and it is noticable in the pics that they are fake and they come after me? What is that about, it's ridiculous and not fair at all and I don't have the time to sue anyone, but I will try to fight it as much as I can.

I'm scared to relist my Abercrombie stuff at all, even WITH my own photos, because they always threaten to revoke my Ebay account. Would it be safer for me to relist these items with my own pics under another Ebay ID? I am scared to relist at all but don't want to eat the money either. What would you do?

P.S. If Abercrombie is so worried about people using their photos, why don't they make their website so you can't right click & do save as on their pics! Most higher end clothing companies have their websites set up that way. Seems like a logical answer to the problem to me.

How can they take your 7 auctions down if you didn't do anything technically wrong? You didn't use their photos and they were authentic? I am beginning to hate VERO. -

There many ways, to get the pictures of right desabled sites. If you want to know, pm me, I don`t want to take this important tread to OT.
I think, they vero the auctions with their pictures, cause its just a reason. They really don`t care if you use their pictures, the just need a reason to cancel the listenings. And a picture is a good way for them.
Another point is, when the remove the listenings with A&F Fotos (and btw. you may also not allowed to use their Logo) you have to make pictures yourself. And sometimes a picture says more than 1000 words
