    Escrow.com advertises on their web site front page:

    “Internet fraud costs victims millions of dollars each year. Protect yourself with Escrow.com! We protect both the buyer and seller with a simple, 5-step trust process.

    Escrow job is to ensure the quality/arrival of the product that the buyer buys and to ensure that the money will be paid to the seller.”

    Escrow.com fraudulently represents that they protect the buyer and the seller and ensures that money will be paid to the seller. This is all good in theory but in reality Escrow.com will not take any stand and if there is the slightest disagreement between the buyer and seller. Escrow will hold the fund until the disagreement is resolved, which could take over a year or more!

    This site was established because I was a victim of Escrow.com's fraudulent misrepresentation. Escrow.com has been holding my funds for more than a year, and I believe that the consumer needs to know about this, so that it will not happen to you!

    My Case Summary

    I sold a car on ebay on Nov 11, 2003 and until today I have not received the payment for the car, or the car itself!

    Ebay had, and still is, advertising and recommending customers to use Escrow.com.

    I, like probably thousands and even millions of Ebay customers used Ebay's recommendation to use Escrow.com and that is what has kept me from the money I am entitled to.

    Here’s what happened…

    I offered a car for sale on Ebay, and it was won by a buyer, who he and I agreed to use Escrow.com at Ebay's recommendation. After the buyer deposited the funds into Escrow.com, I shipped the car to the buyer.

    The buyer rejected the car, and under the rules of Escrow, had 10 days to reject the purchase and return the car to the Seller. The buyer falsely represented to Escrow that he shipped the car back to me. In fact, he did not ship the car. The Buyer continued to maintain possession of the car past the 10 day return period.

    Escrow at all times was aware of the aforesaid fact, and notwithstanding my timely demand to forward the escrowed sum pursuant to the terms under the Agreement, breached their contract and continued to maintain possession.

    After countless pleas for Escrow to remit the purchase price, they ignored me for months, as I attempted to contact them via phone, mail, and email.

    It was only when I retained a lawyer that they responded, but still they failed to release the funds.

    On May 12, 2003, the case went to Arbitration and the Arbitrator ruled in my favor. He instructed Escrow to release the purchase price for the car that they were withholding, and for Escrow to pay damages for wrongfully withholding the funds. Escrow was required, by the terms of the Arbitration Award, to pay me within 15 days after entry of the award, which entry was on May 27, 2003.

    Escrow requested of the American Arbitration Association (AAA) correction of the Award, and claimed the computation of such damages were in error. This request for modification was denied, and the Award dated May 27, 2003 was reaffirmed.

    Escrow.com also filed two motions: to dismiss petition to confirm award; and to quash service of process.

    Let me emphasize that the Escrow.com agreement mandates that the consumer use AAA for any disagreement, yet they do not even respect the AAA decision.

    I don´t know how many trasactions go via escrow.com but its like the business is going. Not everything can be fine. Also at registerd companies which are legit.

    The data on the site is about 18 months old. I have never heard of bad experiences with this service. When I would be the seller, I had take the buyer to court, since its seems that he said, that the seller got the car back. Then he has to prove that.

    Spreading lies over the internet so that the customers are not trust a registerd escrow service and make the offer to take anohter one (which is a fake one).
